Terms of Use (End-User License Agreement)

These terms are an agreement between you and Next Level CPA PLLC ("Next Level CPA", "we", "us") for the use of Next Level Live ("the app"). By signing in or by connecting a QuickBooks Online company to the app, you agree to them. If you use the app for a business, you confirm you are allowed to accept these terms for that business. Your engagement letter with us still governs our accounting and advisory services; if these terms and your engagement letter conflict, the engagement letter controls.
1. What the app is
A private dashboard that shows a business's numbers (cash, profit, profit and loss, money tips, planning tools) built from its QuickBooks Online books. It is provided to clients of Next Level CPA as part of our services.
2. License
We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own business while you are our client (or our staff). You may not copy, resell, sublicense, reverse engineer or build a competing product from the app, or let anyone else use your account.
3. Your account
- Accounts are by invitation. Keep your password and authenticator app private; you are responsible for activity under your account.
- Tell us right away at info@sargiscpa.com or (704) 981-1191 if you think someone else has used your account or if you lose your authenticator device.
- Do not try to reach data of another company, test the app's security without our written permission, or overload it.
4. Connecting QuickBooks Online
- Connecting is optional and is done through Intuit's own consent screen by someone with authority over the QuickBooks company. You authorize us to read that company's accounting data as described in our Privacy Policy.
- The app has read-only use of your books. It does not create, edit or delete anything in QuickBooks.
- You can disconnect at any time, from inside QuickBooks or by asking us. Disconnecting stops new data from flowing; see the Privacy Policy for what happens to data already synced.
- QuickBooks and Intuit are trademarks of Intuit Inc. Intuit is not a party to these terms and is not responsible for the app.
5. The numbers and the advice
- The dashboard is only as accurate as the books it reads and how recently they synced. Months after your last closed month may be incomplete.
- Money tips, benchmarks, tax estimates and "what if" tools are estimates for discussion with your CPA, not promises of savings or results, and not tax, legal or investment advice on their own. Decisions are yours; talk to us before acting on anything significant.
- Sample companies in the app use made-up example numbers and are always labeled.
6. Availability and changes
We work to keep the app available and secure but do not promise it will be uninterrupted or error free. We may change, suspend or retire features. If we stop offering the app, we will tell you in advance where we reasonably can, and you can still get your financial information from QuickBooks and from us.
7. Ending access
Your access ends when our engagement ends, when you ask, or if you break these terms. We may suspend access right away to protect your data or the app. Sections 5, 8, 9 and 10 continue after access ends.
8. Disclaimer
Except as stated in these terms or your engagement letter, the app is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
9. Limit of liability
To the extent the law allows, Next Level CPA is not liable for indirect, incidental, special or consequential damages, or for lost profits, arising from use of the app, and our total liability for any claim about the app is limited to the fees you paid us in the three months before the claim. Nothing here limits liability that cannot be limited by law.
10. Law
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.
11. Changes to these terms
We may update these terms. We change the date at the top, and for significant changes we tell you by email or in the app before they take effect. Continuing to use the app after that means you accept the new terms.
